Please ensure you read through the Terms and Conditions prior to placing any orders with Fifth Studio Design Co. You agree to all of the provisions contained or referred to in these Terms and Conditions. Fifth Studio Design Co. Reserves the right to changes these Terms and Conditions at any time.

TERMS AND CONDITIONS
‘Natalie Pasnin Design Pty Ltd.’ trading as Fifth Studio Design Co. ‘The Client’ is the party making a booking for design related services from Fifth Studio Design Co. ‘An Order’ is the request for services from Fifth Studio Design Co. ‘The project’ is a term used to describe a service from Fifth Studio Design Co. The terms and conditions apply to all dealings between The Client and Fifth Studio Design Co. By placing an order with Fifth Studio Design Co., you as a Client are forming a legally binding contract for services and you agree to the following terms & conditions. You agree to follow the terms and conditions and Fifth Studio Design Co. reserves the right to change any of the terms and conditions at any time without prior notice.

INITIAL CONSULTATION / DESIGN BRIEF
Fifth Studio Design Co. and the Client will attend an initial consultation at no charge to the Client, via phone or email. A (Brief) will be constructed through the collection the information and inspiration received by client, providing a foundation and direction for client’s Business Design requirements. Fifth Studio Design Co. offers a set number of (2) two revisions for custom logo design and branding or graphic design services. Any additional work, revisions or changes will be charged at an hourly rate of $100 per hour.

QUOTATIONS
All quotations are valid for 30 days. Any quote not accepted within this time is subject to a re-quote.
All prices are quoted in Australian Dollars. Any additional work not quoted, or outside the original scope relating to the project will be charged at an hourly rate of $100 per hour. Fifth Studio Design Co. is not responsible for increases in materials by third party services (eg printers, sign writers, web developers) where the increases are beyond our control.

COPYRIGHT
The Client assumes full Copywrite and reproduction rights upon full payment of a completed project.
Fifth Studio Design Co. retains personal rights to use completed projects and concept artwork for the purpose of marketing for Fifth Studio Design Co. All images displayed on the Fifth Studio Design Co. website, Instagram page, TikTok page and Facebook page are subject to Copywrite, and must not be copied or used without full permission from Fifth Studio Design Co. and the Client. Any breach of Copywrite will result in action being taken as necessary.

DESIGN CREDIT
The Client allows Fifth Studio Design Co. to display any projects on the Fifth Studio Design Co. website or social media pages, and portfolio for self-promotion purposes. The Client agrees to allow Fifth Studio Design Co. to credit design work on all websites designed by Fifth Studio Design Co.

CANCELLATIONS & INCOMPLETE PROJECTS
All work not completed within a 3 month period will be invoiced regardless. Payment is required for any artwork or drafts, that have been terminated on your request at any stage of development, prior to completion. Invoice will be issued as ‘work to date’. In the event of a project cancellation, Fifth Studio Design Co. retains ownership of all copywrite and original artwork. Any concepts, designs or ideas not chosen by the Client remain the property of Fifth Studio Design Co. and may be offered to other Clients.

PAYMENT
A 50% deposit is required for work to begin, unless an amendment is made in this contract, the balance will be paid upon completion of project, only then will files be handed over. Payment is required prior to releasing final digital files and/or supplying files for printing and websites. Payment must be made within 7 days of the date of the invoice. All work is presented to you in draft format. Once payment is received you will receive final files. Payment can be made via direct deposit or Direct Debit via Stripe.
If debt collection is required for unpaid invoices, The Client is responsible for any costs incurred (fees/commissions payable to the debt collectors)

REFUNDS
Refunds will not be issued due to a customer’s change of mind prior to or after a product has been delivered. Refunds will only be issued if deemed necessary by Fifth Studio Design Co. All deposits are non-refundable.

TURNAROUND TIMES
Fifth Studio Design Co. will make every effort to meet deadlines. All quoted turnaround times are approximate.
Fifth Studio Design Co. will not be held responsible or liable for any costs resulting from late artwork or printing deliveries.

AUTHORS CORRECTIONS
The Client is allowed two sets of revisions to their project, unless specified in the signed off contract.
Any authors corrections or amendments outside of the quotation or nominated 2 sets of revisions, are charged at an hourly rate of $100 p/hr. Fifth Studio Design Co. makes every effort to deliver concepts to suit the Client’s brief. If the Client is not happy with the concepts provided by Fifth Studio Design Co., and the amends do not fall within minor ‘revisions’ to the project, the Client can pay for further concepts to be developed or choose to not proceed, and pay for ‘work to date’.

APPROVAL
Approval is required for all projects, sent via HelloSign. Whilst all care is taken by Fifth Studio Design Co., Fifth Studio Design Co. is not responsible for any spelling, grammatical, or numerical errors, or omissions after final approval. Even if text or visual errors are from Fifth Studio Design Co., it is the Client’s responsibility to proofread and check thoroughly their projects to identify any errors prior to approval.
The Client is fully responsible for reprint and production costs should they decide to print again.
No refunds will be issued by Fifth Studio Design Co.

FILE SUPPLY
Fifth Studio Design Co. supplies files to printers at a minimum of 300 dpi or as high resolution PDF files.
Fifth Studio Design Co. supplies logo files to the Client in print and web formats, as EPS. PNG. JPEG and PDF.
Other than logo supply, Fifth Studio Design Co. will only supply working files if requested (ie Adobe Indesign & Illustrator files). High-Resolution PDFs of artwork can be supplied at the Clients request at the time of project completion Supply of any files after project completion will incur a fee, to cover times spent to retrieve files from archives. Any additional file format supply will also incur a fee charged at an hourly rate of $100p/hr.

IMAGES
Some designs may contain stock photography that is available for purchase. Any items designed by Fifth Studio Design Co. that are offered for sale will require license rights to be purchased for any stock images.
Any images supplied by the Client must be provided in high resolution, preferably CMYK.
Fifth Studio Design Co. is not responsible for colour variations in conversion from RGB to process CMYK.
Fifth Studio Design Co. is not responsible for the reproduction quality of supplied images.

COLOUR MATCHING & PRINTING
Whilst all care is taken, Fifth Studio Design Co. does not take responsibility for Client supplied artwork that does not print properly. Fifth Studio Design Co. is not liable for any printing errors, using the Clients chosen printer, unsupervised by Fifth Studio Design Co.. Please note that colour on projects can vary from screen to final product. Screen proofing is not indicative of final printed piece. Printed colours can vary from printer to printer, job to job, run to run, or even front to back, due to the nature of the CMYK printing process.
Trimming can vary from printer to printer. Text should not be placed within 3mm from any edge.

SOCIAL MEDIA
Fifth Studio Design Co. has no control and accepts no responsibility for changes to Social Media sizing which may include, banners, posts or highlights. If there is a need for changes a fee will be applied to fix and rectify these problems if they occur.

Shop Policy

SHIPPING POLICY

Canva Templates & Digital Products. Due to the digital nature of the products sold, you will not receive a physical product in the mail. Upon purchase, you will receive a download link to a PDF which will contain either a brand brief or the Canva links and/or a ZIP folder with a PDF and Adobe files.

RETURN AND REFUND POLICY

Due to the digital nature of the products sold, all sales made are final. There will be no refunds or exchange of items once a purchase is complete. For technical difficulties and other inquiries, please contact nat@fifthstudiodesign.com.au

CANVA DISCLOSURE

The fonts, images, and elements used are all available on Canva. Please note that you are purchasing the template only. As a Canva user, you may use these elements, including the images and fonts. If there is a premium element or image in the template, you can use them as a pro member, or change the element (or image) with a free element (or image). All fonts used in the templates are available in the free version of Canva.

LICENCE

You may use your purchased template(s) for personal use or commercial use. Each purchase grants ONE license to you – the buyer – only. See usage details and restrictions below:

  • Under this license, you may use this template to create end-products ONLY.
  • You may NOT redistribute or resell this product or modified version of this product in its editable template format.
  • Personal Use: Under this license, you may create an unlimited number of end products using this template, for your personal use.
  • Commercial Use: Under the license, you may create commercial end-products up to 5000 copies. It may be that you create one end-product and sell 5000 copies of that one product, or create 10 end-products and sell 500 copies each. If you need to create multiple products for yourself or for clients for commercial use and the end-products exceed a total of 5000 copies, then please purchase another license of the product.

LOST FILES

You are responsible for keeping your design files in a safe place. Please back up important files or links and store them in a safe location.

TECHNICAL SUPPORT

Please be aware that Fifth Studio Design Co. does not help with the installation of any design elements. You must be able to make these changes on your own or hire out to make such changes. Fifth Studio Design Co. is not responsible for implementing any design you may purchase.

SKILLS

For templates and editable files, you don’t need to be a Canva, Photoshop, or Illustrator pro, but you should definitely have a working knowledge of the program you choose to use, such as how to manipulate images, layers, colours, shapes and text. Fifth Studio Design Co. is not responsible for explaining how to use editable files.

PERSONAL INFORMATION

All personal information you provide will be used to ensure email deliveries to you. The information you provide is only available to Fifth Studio Design Co. and will not be shared with other third parties.

PAYMENT

Credit Card information is not stored and all card information is handled over SSL encryption. Please read the terms & conditions for the payment gateway chosen for the transaction as they are responsible for the transactions made.
